SFWA Dissects Kindle Contract

I'm not impressed with much of the SFWA, but they do have one stellar service: the Contract Committee. The CC has dissected Amazon.com's Kindle contract. It's pretty unpleasant ... put on your lab apron and safety goggles.

Any way you could give us the cliff notes? Hate reading long things online, especially in Legalese.

It sucks.

Amazon hoards all the advantages, leaving the disadvantages to the writer (who is considered the publisher). Amazon does not promise to protect your work from copyright infringement. The contract can be interpreted to allow others to create derivative works from yours with no recompense to you.

You waive the right to sue Amazon for anything except money allegedly owed to you by Amazon but not paid properly.

There's more, but those are some of the main deal breakers.

It's very disappointing, because Amazon has the potential to be so hugely useful, and they're making themselves very unattractive. The first thing I did when I heard about the Kindle was go check the contract to see if this would be an appealing market for my deadzone fiction. It wasn't.
Yeah, they really need to rethink that contract.
